Submitting a booking request through our site or an external scheduling tool constitutes a request for a consultation, not a binding commitment to purchase services. No services agreement exists until a separate Master Services Agreement or Statement of Work is signed by both parties.
12. Separate Services Agreement Controls Paid Services
These Website Terms of Use govern your use of this website only. They do not constitute a services agreement. If you engage SwiftSocial for marketing services, the terms of the separately signed Master Services Agreement (MSA), Statement of Work (SOW), or other written engagement will control the service relationship. In the event of any conflict between these Website Terms and a signed services agreement, the signed agreement will govern.
13. Disclaimer of Warranties
The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. SwiftSocial disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
14. Limitation of Liability
To the fullest extent permitted by applicable law, SwiftSocial LLC, its members, managers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, regardless of the theory of liability.
